Probate is the name of the court in Florida (and also many other states) that is responsible for overseeing the administration of a decedent's (dead person's) assets, such as real estate, accounts, and physical items. The orderly process of "administering an estate" typically includes appointing a personal representative who is tasked with identifying all assets, looking for debts or potential debts, using the assets (with some exceptions) to pay off debts, and then distributing what is left to the beneficiaries in the Will (or if there is no Will, to the heirs at law.) the estate of a deceased person. Unless alternate arrangements were made during the decedent's lifetime (such as through a trust), the power to do all of this comes from the Florida probate court.
Florida law requires that the person administering a Florida probate case must be represented in that probate court case by a Florida attorney.
